Copyright Infringement Notice

Sub2Earn respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify our copyright agent as set forth in the DMCA.

Required Information

For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, with sufficient detail so that we can locate it on our service
  4. Your contact information, including your address, telephone number, and email address
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Important Notice: Providing false or misleading information in a DMCA takedown notice may result in civil liability for damages, including costs and attorneys' fees.

How to Submit a DMCA Notice

Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who posted the material that it has been removed or disabled
  3. Terminate repeat infringers' accounts in appropriate circumstances

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us.

Counter-Notice Requirements

A counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Sub2Earn may be found
  6. A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

Repeat Infringer Policy

Sub2Earn has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Safe Harbor

Sub2Earn qualifies for the Digital Millennium Copyright Act's safe harbor provisions. We act as a service provider and do not have actual knowledge of the content being locked by our users until such content is brought to our attention.

No Liability for Removal

Sub2Earn will not be liable to any user of the Service for the removal of any material. We reserve the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability to you.

False Claims

The DMCA provides that any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. We reserve the right to seek damages from any party that submits a DMCA notification or counter-notification in violation of the law.

We may update this DMCA Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Last Updated" date.
